Mediation is an important and valuable tool in resolving disputes. Mediation allows parties involved in a dispute to reach a negotiated settlement or resolution, thus putting an end to expensive litigation and avoiding the stress, expense and uncertainty of trial.
A mediator is a completely neutral party who is committed to assisting the parties to work toward a mutually agreeable resolution of their dispute.
A skilled mediator will help parties involved in a dispute by identifying the issues and interests that all sides have, assisting the parties to then evaluate their positions and the positions of the other parties thereby encouraging dispassionate analysis – all in a completely confidential setting.
Even if a mediation does not result in a settlement, a mediation helps participants by allowing them to resolve some (if not all) of the issues, gain an appreciation of strengths and weaknesses of positions (theirs and others’), consider alternative resolutions, etc. This process often leads to fruitful negotiations and eventual resolution. Further, mediators can be available to assist parties even after the formal mediation has ended.
